These Terms and Conditions govern the use of Cairnvale's services and this website. By engaging a Cairnvale service or submitting an enquiry, you confirm that you have read and accepted these terms. Please read them before proceeding.
Cairnvale is a clerical and archival service operating from 81 Jalan Kuchai Lama, 58200 Kuala Lumpur, Malaysia. References to "Cairnvale", "we", "us", or "our" mean the business at that address.
1. Definitions
- Services
- — the clerical and archival services offered by Cairnvale, as described on this website, including records sessions, digitisation projects, and retainer arrangements.
- Client
- — the individual or family who engages a Service under a signed handling agreement.
- Handling Agreement
- — the written agreement signed before any document collection or project work begins, naming the scope, the authorised persons, and the return procedure.
- Website
- — this website at https://cairnvalads.biz.
- Outputs
- — written documents produced by Cairnvale at the end of a service engagement, including next-steps sheets, indexes, correspondence logs, and annual reports.
2. Acceptance of terms
By submitting an enquiry through this website or by telephone, or by signing a Handling Agreement, you agree to be bound by these Terms and Conditions. Use of this website for information purposes does not itself constitute agreement to a service engagement.
You must be at least 18 years of age and have the legal capacity to enter into an agreement under Malaysian law. If you are acting on behalf of a family group, you confirm that you have authority to act in that capacity.
3. Service description
Cairnvale provides clerical and archival support for families working through inheritance documentation and estate records. Services are custodial and organisational. Cairnvale does not provide legal advice, financial advice, estate administration, document interpretation, document drafting, or any regulated professional service.
The three currently available services are described on this website and in the Handling Agreement. Services are available to clients in Malaysia. Engagements involving households outside the Klang Valley may be subject to travel arrangements to be agreed in writing before the Handling Agreement is signed.
Cairnvale reserves the right to decline an engagement if it falls outside the scope of its clerical and archival capabilities.
4. Client responsibilities
- Provide accurate information about the documents and household at intake
- Sign the Handling Agreement before any documents are collected or work begins
- Ensure that you have the authority to make decisions about the documents in scope
- Confirm receipt of returned documents and digital outputs in writing
- Inform Cairnvale promptly of any changes in contact details or household circumstances relevant to an active project
- Not present documents for handling that are subject to a court order preventing their movement or reproduction
5. Intellectual property
The content of this website — including text, layout, and design — is owned by Cairnvale and may not be reproduced without permission.
The written Outputs produced for a client during a service engagement (next-steps sheets, indexes, annual reports, correspondence logs) are produced for that client's use. Cairnvale does not retain ownership of these documents after handover. Outputs may not be altered to misrepresent their source or the nature of Cairnvale's services.
6. Payment
All prices are stated in Malaysian Ringgit (RM). Published prices are:
- First Steps Records Session: RM 460
- Estate Papers Digitisation (up to 800 pages): RM 1,620
- Family Records Stewardship Retainer (twelve months): RM 4,350
For digitisation collections exceeding 800 pages, a written estimate is provided before any work begins. The estimate must be accepted in writing before the Handling Agreement is signed for that project.
Payment terms and accepted methods are stated in the Handling Agreement. Cairnvale does not begin project work before payment conditions specified in the Handling Agreement have been met.
Refunds: where Cairnvale is unable to complete a service due to circumstances on its side, a pro-rata refund of fees paid will be provided. Fees for completed sessions or completed portions of a digitisation project are not refundable. Cancellations requested by the client after project work has begun are subject to the cancellation terms in the Handling Agreement.
7. Disclaimers
Cairnvale's services are clerical and archival. We make no statement about the legal validity, financial value, or significance of any document we handle. Nothing in our Outputs constitutes legal or financial advice. Written next-steps sheets and referral directories are organisational aids, not professional opinions.
This website is provided for information purposes. While we take care to keep it accurate, we do not warrant that it is complete or current at any given time.
8. Limitation of liability
To the extent permitted by Malaysian law, Cairnvale's total liability arising from a service engagement is limited to the fees paid for that engagement. We are not liable for indirect, consequential, or economic losses arising from our services or from reliance on our Outputs.
In the event of physical damage to documents held at our premises, our liability is limited to the reasonable cost of reproduction where reproduction is possible. For irreplaceable documents, the Handling Agreement specifies the care protocols and the agreed allocation of risk.
9. Indemnification
You agree to indemnify Cairnvale against claims arising from: (a) your misrepresentation of authority over documents provided for handling; (b) your use of our Outputs in a manner that misrepresents their nature or source; or (c) your breach of these Terms.
10. Termination
Either party may terminate an active service engagement by written notice. Where termination is requested by the client, fees for work completed to the date of notice are payable. Where termination is initiated by Cairnvale without cause, fees paid for uncompleted work are refunded on a pro-rata basis.
On termination, all documents held by Cairnvale are returned to the client within five business days. Any digital copies held on Cairnvale's systems are deleted after confirmed return of the documents.
11. Dispute resolution
In the event of a dispute, the parties agree to first attempt informal resolution by written correspondence. If the matter is not resolved within 30 days, it will be referred to mediation in Kuala Lumpur before any litigation is commenced.
These Terms are governed by the laws of Malaysia. The courts of Malaysia have jurisdiction over any disputes not resolved through mediation.
12. General provisions
- Entire agreement: these Terms, together with the Handling Agreement, constitute the full agreement between Cairnvale and the client for a given engagement.
- Severability: if any provision is found to be unenforceable, the remaining provisions continue in full force.
- Waiver: failure to enforce any provision does not constitute a waiver of the right to enforce it in future.
- Assignment: Cairnvale may not assign its obligations under a Handling Agreement without the client's written consent. The client may not assign without Cairnvale's consent.
- Notices: written notices should be sent to the address and email below, or as specified in the Handling Agreement.
13. Changes to these terms
These Terms may be updated from time to time. The date at the top of this page reflects the last revision. Changes do not affect Handling Agreements already in place at the time of revision. Continued use of this website after a revision constitutes acceptance of the updated Terms.
